has been informally appointed as the Personal Representative of the estate to serve without surety on the bond.

The estate is being administered under informal procedure by the Personal Representative under the Massachusetts Uniform Probate Code without supervision by the Court. Inventory and accounts are not required to be filed with the Court, but interested parties are entitled to notice regarding the administration from the Personal Representative and can petition the Court in any matter relating to the estate, including distribution of assets and expenses of administration. Ferreira to JPMorgan Chase Bank, N.A. recorded with the Plymouth County Registry of Deeds in Book 39022, Page 50, the undersigned U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of the Truman 2021 SC9 Title Trust being the present holder of said mortgage by Assignment of Mortgage dated June 25, 2018 from JPMorgan Chase Bank, National Association to New Penn Financial, LLC d/b/a Shellpoint Mortgage Servicing recorded in Book 50051, Page 198, Assignment of Mortgage dated January 19 , 2023 from Newrez LLC d/b/a New Penn Financial, LLC d/b/a Shellpoint Mortgage Servicing to U.S. Bank Trust National Association, not in its individual capacity, but solely as trustee of the Truman 2021 SC9 Title Trust recorded in Book 57628, Page 199, and Corrective Assignment of Mortgage dated April 7, 2023 from Newrez LLC f/k/a New Penn Financial, LLC d/b/a Shellpoint Mortgage Servicing to U.S. Bank Trust National Association, not in its individual capacity, but solely as Trustee of the Truman 2021 SC9 Title Trust recorded in Book 57821, Page 271, for breach of the conditions of said Mortgage and for the purpose of foreclosing the same will be sold at Public Auction at:

upon the hereinafter-described premises, known as and numbered as 43 Hartley Road, Rochester, Plymouth County, Massachusetts, all and singularly the premises described in said mortgage, to wit:

That certain parcel of land situated in Rochester, Plymouth County, Commonwealth of Massachusetts, bounded and described as follows:

Beginning at a stub on the northerly side of Rochester Road, that leads from Hartley’s Mill to Waterman School House, and of land formerly owned by John L. Sylvia;
Thence by survey of 1923 North 36 degrees west three hundred forty (340) feet to an angle in said Sylvia’s Line;
Thence West 32 ¼ degrees South in line of last named land one hundred eleven (111) feet to a corner;
Thence South 36 degrees East three hundred fifty-six and one half (356 ½) feet to said highway; and Thence Easterly in the northerly line of said highway one hundred eleven (111) feet to the place of beginning.
Containing one hundred forty-one and 9/10 (141.9) square rods, more or less.

The above-described premises shall be subject to all easements, restrictions, municipal or other public taxes, assessments, liens or claims in the nature of liens, outstanding tax titles, building, zoning and other land use laws and all permits and approvals issued pursuant thereto, including, without limitation, orders of conditions, and existing encumbrances of record created prior to said Mortgage, if there be any. Said premises are to be sold subject to the right of redemption of the United States of America, if any there be.

TERMS OF SALE: The highest bidder shall be required to make a deposit of $10,000.00 to the holder of said Mortgage, in cash or by certified or bank cashier's check at the time and place of said sale of said premises. The balance of the purchase price is to be paid to said holder in cash, by certified check or bank cashier's check, and thereupon the deed shall be delivered, in thirty (30) days from the date of sale at the firm of Cunningham, Machanic, Cetlin, Johnson, Harney & Tenney, LLP, Attorneys for said holder, 220 North Main Street, Suite 301, Natick, Massachusetts. The successful bidder shall be required to sign a
Memorandum of Terms of Sale. The description of the premises contained in said Mortgage shall control in the event of an error in publication. Other terms, if any, to be announced at the time and place of sale.
